These Terms & Conditions (“Terms”) govern your access to and use of the website operated by Nurses Nest (“we”, “us”, or “our”). By accessing or using our website, contacting us about a membership, or purchasing a membership, you agree to these Terms. If you do not agree, please do not use our website.

These Terms apply in addition to our Privacy Policy, which explains how we handle personal information.

2. Website purpose

Our website provides general information about our business and services and allows you to purchase a Nurses Nest membership. Content is provided for general information only unless we expressly agree otherwise in writing.

3. Enquiries and information requests

• When you contact us about a membership, you agree to provide accurate and complete information.
• Contacting us does not guarantee that we will provide a service or a response within any particular timeframe. We may decline or prioritise enquiries at our discretion, subject to applicable law.
• Any indicative pricing given before a formal written agreement is not binding unless we confirm it in writing.

4. Marketing communications

Where you have opted in, we may send you newsletters or promotional emails. You may unsubscribe at any time using the link in those emails. We comply with the Spam Act 2003 (Cth) for commercial electronic messages.

5. Third-party services and links

Our website may rely on or link to third-party services (including analytics, our payment provider, spreadsheet and email tools, and our community platform). Those services have their own terms and privacy practices. We do not control third-party sites and are not responsible for their content or availability.

6. Intellectual property

Unless otherwise stated, we own or license the content on this website and in the member materials (including text, graphics, logos, layout, spreadsheets and templates). You may view and print pages, and use the member materials, for your own personal, non-commercial use. You must not copy, scrape, redistribute, resell or exploit our content without our prior written consent, except as permitted by law.

7. No professional advice

Information on this website, and the budgeting tools, coaching and materials provided with a membership, are general in nature. They do not take into account your objectives, financial situation or needs, and are not professional, legal, financial, credit or taxation advice. You should obtain your own advice from a licensed professional before relying on our content or making an important financial decision, including any decision to borrow or to purchase property.

Any savings figures, timeframes or results described on this website are examples only. They are not a promise, forecast or guarantee of the results you will achieve.

8. Limitation of liability

To the maximum extent permitted by law, we exclude liability for loss or damage arising from your use of our website, including from interruptions, errors, or harmful content, except where liability cannot be excluded under the Australian Consumer Law or other applicable legislation.

Where our liability cannot be excluded, it is limited to the maximum extent permitted by law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

9. Indemnity

You agree to indemnify and hold us harmless against claims, losses, or costs arising from your misuse of our website, breach of these Terms, or violation of third-party rights, except to the extent caused by our negligence or breach.

10. Governing law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia.

11. Changes

We may update these Terms from time to time. The updated Terms will apply from the time they are posted on this page. Continued use of our website after changes constitutes acceptance of the revised Terms.

12. Membership — purchase and contract formation

The following additional terms apply to your purchase of a Nurses Nest membership. If there is any inconsistency between these membership terms and the general terms above, these membership terms apply to your purchase.

• Placing an order through our checkout is an offer by you to purchase a membership on these terms. The confirmation email sent after checkout acknowledges receipt of your order — it does not, by itself, mean we have accepted it.
• A binding contract is formed when we accept your order, which we typically do by activating your membership and providing access to the member materials. Until then we may decline or cancel the order for any lawful reason, including a suspected fraudulent order, a pricing or description error, or our inability to provide the service to you.
• If we cancel an order you have already paid for, we will refund the amount you paid using the original payment method.

13. Pricing, GST and currency

• Unless stated otherwise, prices shown on the website are in Australian Dollars (AUD) and, where applicable, include GST.
• Any payment surcharge is shown at checkout before you confirm your order.
• We try to ensure prices are correct, but occasional errors occur. If we discover a clear pricing or description error after you place an order, we will contact you to either confirm the corrected price (which you may accept or decline) or cancel the order and refund any amount you have paid.
• Prices and availability may change at any time without notice. Changes do not affect orders we have already accepted, and do not affect the price of a current membership term that has already been paid.

14. Payment

• Payment is required in full at checkout, except where we expressly offer another payment option.
• Payments are processed by Stripe, a third-party PCI-DSS-compliant payment provider. We do not see or store your full card number or CVV. Your use of the payment provider is subject to that provider’s own terms.
• We may decline a payment or order where our payment processor flags it as high risk, where the billing details cannot be verified, or where we reasonably suspect fraud.

15. Membership term, renewal and cancellation

• Memberships are sold for a 12-month term. Where your membership is set up to renew automatically, it renews at the end of each term at the then-current price for a further 12 months, unless you cancel before the renewal date.
• You may cancel at any time. Cancellation takes effect at the end of the current paid term — you keep access for the remainder of that term, and are not charged again. Cancelling part-way through a term does not entitle you to a pro-rata refund, except where required by the Australian Consumer Law or under our money-back guarantee below.
• We may suspend or end a membership that materially breaches these Terms, including where member materials are redistributed or resold, or where a member’s conduct in our community is abusive or unlawful.

16. Delivery of the membership

The membership is delivered digitally and through scheduled calls. Access to the budgeting tools and member resources is provided after your payment is accepted. Onboarding calls, group coaching calls and community access are provided at the times we publish or arrange with you. Dates and times for calls may change; where they do, we will offer a replacement session or a recording where one is available.

17. Money-back guarantee, refunds and your ACL rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services re-supplied if they fail to be of acceptable quality and the failure does not amount to a major failure.

30-day money-back guarantee. In addition to your rights above, if you request a refund within 30 days of your first payment, we will refund that payment in full, no questions asked. Contact us using the contact details published on this website to make the request. Refunds are processed to the original payment method. Please allow a reasonable period for your bank or payment provider to credit the refund to your account.

18. Promotions and discount codes

Discount codes and promotional offers, including founding-member pricing, are subject to the specific terms shown with the offer. Unless stated otherwise, codes are single-use per customer, cannot be combined with other offers, have no cash value, and may be withdrawn or amended at any time. We may cancel an order that we reasonably consider involves misuse of a discount code.

19. Limitation specific to membership sales

To the maximum extent permitted by law, and without limiting the general Limitation of Liability clause above, our total liability arising out of or in connection with any membership is limited (at our option) to re-supplying the services, or refunding the price you paid for them. Nothing in these Terms limits rights you have under the Australian Consumer Law that cannot be limited.
